In accordance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI), in relation to Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, the General Data Protection Regulation (GDPR), and Organic Law 3/2018, of 5 December, on Data Protection and Guarantee of Digital Rights (LOPDGDD), it is mandatory to obtain the express consent of users of all websites that use non-essential cookies before they browse them.
What are cookies?
Cookies and other similar technologies such as local shared objects, flash cookies or pixels are tools used by web servers to store and retrieve information about their visitors, as well as to ensure the correct functioning of the site.
Through the use of these devices, the web server is able to remember certain data about the user, such as their preferences for viewing pages on that server, username and password, products of most interest to them, etc.
Cookies affected by regulations and exempted cookies
According to the EU directive, cookies that require informed consent from the user are analytics cookies and advertising and affiliate cookies. Technical cookies and those necessary for the functioning of the website or the provision of services expressly requested by the user are exempt.
By purpose
- Technical and functional cookies: these allow the user to browse a website, platform or application and use the different options or services available on it
- Analytics cookies: these allow the person responsible for them to monitor and analyse the behaviour of users of the websites to which they are linked. The information collected through this type of cookie is used to measure the activity of websites, applications or platforms and to create browsing profiles of users of those sites, applications and platforms, with the aim of introducing improvements based on the analysis of usage data.
- Advertising cookies: these allow the most efficient management possible of the advertising spaces that the publisher may have included on a website, application or platform, based on criteria such as the edited content or the frequency with which ads are displayed.
- Behavioural advertising cookies: these collect information about the user's personal preferences and choices (retargeting) to allow the most efficient management possible of the advertising spaces that the publisher may have included on a website, application or platform.
- Social cookies: these are set by social media platforms within their services to allow you to share content with your friends and networks. Social media platforms have the ability to track your online activity outside of the Services, which may affect the content and messages you see on other services you visit.
- Affiliate cookies: these allow tracking of visits coming from other websites with which the site has an affiliate agreement.
- Security cookies: these store encrypted information to prevent the data stored in them from being vulnerable to malicious third-party attacks.
By ownership
- First-party cookies: these are sent to the user's device from a computer or domain managed by the publisher itself, from which the service requested by the user is provided.
- Third-party cookies: these are sent to the user's device from a computer or domain that is not managed by the publisher, but by another entity that processes the data obtained through the cookies.
By retention period
- Session cookies: a type of cookie designed to collect and store data while the user accesses a website.
- Persistent cookies: a type of cookie in which data remains stored on the device and can be accessed and processed for a period defined by the person responsible for the cookie, ranging from a few minutes to several years.
